I, the undersigned herein, (the “Client”) understand that by clicking the purchase button, or otherwise enrolling, electronically, verbally, or otherwise, agree to be provided with the services as outlined on the check-out page and acknowledge that I am above the age of eighteen [18] years and voluntarily seeking the services of Empower! Tarot Coaching for the purposes of receiving a Tarot Reading.
I understand that as part of the Tarot Reading, I may receive readings from the following disciplinaries: Tarot Card Readings in multiple spreads, Animal Totem Cards, Chinese Western Astrology, Birth Soul Cards, Channeling of Messages through automatic writing, and other energetic work as applicable (the “Reading”).
I. CONSENT
1.1 I give permission to Empower! Tarot Coaching to connect with my energy field in order to conduct the Reading. I understand that this may involve Empower! Tarot Coaching using their intuition, empathic abilities, or other energetic techniques to gather information during the Reading.
1.2 I further authorize Empower! Tarot Coaching to receive messages or insights on my behalf during the Reading. I acknowledge that these messages may come through the tarot cards, Empower! Tarot Coaching intuition, or other means of divination.
1.3 I acknowledge that I have the right to set boundaries during the Reading and can request Empower! Tarot Coaching to refrain from certain actions, topics, or inquiries that make me uncomfortable. I understand that I have the right to terminate the Reading at any time if I feel uncomfortable or to stop the energy access or message reception.
II. WAIVER OF LIABILITY
2.1 I acknowledge that the Reading is subjective and interpretive in nature, and the outcome or accuracy of a Reading cannot be guaranteed. I further understand that Empower! Tarot Coaching does not possess any special powers, and the information provided during the Reading is based on their interpretation of the cards.
2.2 I understand that the Reading is not meant to be a substitute for professional advice, counseling, or therapy, and understand that I must perform my own due diligence prior to making any decisions. I acknowledge and agree that I am fully responsible for my own actions, decisions, and choices made based on the information provided during the Reading. I understand that I have the free will to accept or reject any guidance or advice provided during the Reading, and I am solely responsible for any consequences that may result from my choices or actions.
2.3 I hereby release, and discharge Empower! Tarot Coaching and any affiliated individuals or entities from any and all liability, claims, demands, actions, or causes of action arising out of or related to the Reading. I understand that Empower! Tarot Coaching shall not be liable for any direct, indirect, incidental, consequential, or punitive damages, or any other damages of any kind, including but not limited to financial loss, emotional distress, or injury, arising out of or related to the Reading.
2.4 I am aware that this is a release of liability and knowingly, voluntarily, and expressly waive any claim that I may have against Empower! Tarot Coaching for injury or damages that I may sustain as a result of my participation in the Reading
III. CONFIDENTIALITY
3.1 Empower! Tarot Coaching will make every effort to maintain the privacy and confidentiality of the Reading unless either of the following circumstances become present (i) if the Client discloses intentions or plans to harm themselves, or (ii) if the Client discloses intentions or plans
to harm others. In such circumstances, Empower! Tarot Coaching may be obligated to take appropriate action to ensure the Client’s safety, and/or safety of others. Empower! Tarot Coaching may further be required by law, court order, or other to disclose information shared by the Client.
IV. MEDIA RELEASE
4.1 The Client hereby grants full permission to Empower! Tarot Coaching to photograph, and/or record the Reading in which the Client is participating under this Agreement. The Client acknowledges that Empower! Tarot Coaching may use the photographs, motion pictures, videotapes, recording or any other record of the Client’s participation for purposes of social media, website, advertising, online courses, archiving, and without limitation, commercial use
(hereinafter: the “Media”). Empower! Tarot Coaching will take every endeavor to ensure the privacy and well-being of the Client is taken seriously in the Media. If the Client does not wish to be photographed and/or recorded, they can advise Empower! Tarot Coaching Prior to the Reading.
V. NON-DISPARAGEMENT
5.1 The Client shall not at any time directly or indirectly take any action and/or make, publish, file, record any oral or written statements that would likely have a negative or injurious impact upon, or that is derogatory, defamatory, libel or slanderous in nature on Empower! Tarot Coaching or their services in any way without prior consultation with Empower! Tarot Coaching to reach a resolution.
VI. MISCELLANEOUS
6.1 Severability: If any provision of this waiver of liability is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
6.2 This Agreement will be governed and construed in accordance with the law of the Province of Ontario. The Client has read, understands, and fully agrees to the terms of this Agreement. The Client has entered into this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise, or guarantee being communicated to them. The Client understands and confirms that by signing the Agreement, or accepting the terms and conditions herein, that they have given up considerable future legal rights. Confirmation by signature or through accepting the terms and conditions at check out, shall be proof of the Client’s intentions to execute a completed and unconditional waiver and release of all liability to the full extent of the law.
